How To Request Discovery

1.  Submit a discovery request to the County Attorney's Office AND the court where the case is pending

• At the bottom of this page you can download generic discovery request forms for District Court and Justice Court cases
   
• The discovery request may be submitted in person or by mail

2.  Pay the required discovery fee

• Click here to go to the payment portal
   
• Consistent with State v. Kearns, 2006 UT App 458, defendants are not entitled to free copies of the discovery
   
• Pursuant to Box Elder County Resolution 09-04 and section 76-5-302 of the Utah Code, the County Attorney's Office charges the following fees for discovery items:

Reports, Documents, and Written Statements
     Electronic Delivery                        $5.00
     25 or less pages printed            $10.00
     More than 25 pages printed      $25.00+
     Citation (with notes)                    Free

      CD or DVD                                      $5.00/disc
      USB flash drive                              $10.00/drive
